The Court of Appeal Sokoto Division has struck out a suit filed by Sen. Adamu Aliero (PDP Kebbi), who challenged the decision of Federal High Court over party primary election.
Justice Muhammad Danjuma, who read the judgement on behalf of others, upheld the Justice Babagana Ashigar of Federal High Court Birnin Kebbi’s judgement that produced Alhaji Haruna Sa’idu as Peoples Democratic Party (PDP) candidate.
The respondents are PDP and Independent National Electoral Commission (INEC). Justice Ashigar, on September 27, this year, upheld the primary election that produced Alhaji Sa’idu as authentic Senatorial candidate for Kebbi Central seat.
The appeal court judge said he perused all the arguments presented by different counsels, citations of court judgments and other judicial considerations and arrived at the decision.
He further said the eight appeal legs were considered, thereby dismissed the suit based on lack of merits and upheld the lower court judgment.
